Conditions of Booking
1. Booking
We will hold provisional bookings made by telephone for seven days. We will proceed on receiving a completed booking form with deposit of 20% of the total fee. Our written acceptance will state the balance due, payable not later than four weeks before embarkation. Payment must be made in full for bookings accepted within four weeks of embarkation.
2. Cancellation
If the yacht or berth becomes unavailable as booked, all money paid will be refunded in full and you will have no further claim against Cruise Ecosse Ltd. If you cancel your booking, all money paid will be refunded less an administration charge of 10% of the total fee, provided (1) we receive your cancellation in writing at least four weeks before embarkation and (2) we can relet.
3. Insurance
Participation in activities aboard the yacht is at your own risk and neither Cruise Ecosse Ltd nor the Skipper will accept responsibility for death, injury or for damage or loss of property. It is recommended that you arrange personal accident, cancellation and damage to or loss of personal effects insurance before embarking. Non UK residents must be adequately covered by medical, personal accident and repatriation insurance before embarking and must carry insurance documentation with them.
4. Variation
Neither Cruise Ecosse Ltd nor the Skipper accept liability if the cruising area is altered because of inclement weather or for any cause beyond their control, and no financial adjustment will be made in this event.
5. After Departure
The description of the yacht and her equipment is generally accurate, but neither Cruise Ecosse Ltd nor Skipper will be liable for any minor inaccuracies. The Skipper is in command of the yacht at all times and his decision is final. When a Cook/Mate is not engaged, you will participate in operating the yacht and therefore you must be medically fit to do so. Pets are not permitted aboard.
6. The Law
These booking conditions shall apply to every member of the party and the person signing the Booking Application will do so on behalf of every member of their party. When you book with us and use our application form you accept our conditions and we offer our undertakings as indicated above. In event of any conflict these conditions shall apply. Our acceptance of your booking application will constitute a contract. This contract including all matters arising from it, is subject to Scots Law and the inclusive jurisdiction of the Scottish Courts. We, Cruise Ecosse Ltd shall be entitled to assign any contract formed with you without your consent. You shall not be entitled to assign any such contract without our knowledge.
